Nilda M. Isidro focuses her practice on the representation and defense of product companies, with an emphasis on pharmaceutical, medical device, and consumer product litigation. She litigates a variety of complex matters in both state and federal courts, including mass torts, multi-district litigations (MDLs), and class actions. In addition, Nilda regularly provides strategic counseling to a wide range of clients—at every stage of the product life cycle—on issues including product launches, labeling and warnings, recalls, regulatory compliance, good manufacturing practices (GMPs), product warranties, and related litigation avoidance and risk management issues.

Nilda’s clients typically come from highly-regulated industries, including: life sciences, technology, health care, food and beverage, personal care, and cannabis/cannabinoids. Working closely with a national network of experts in various fields of medicine, materials sciences, and industry regulation, Nilda excels at synthesizing complex scientific and regulatory issues into relatable themes that can be easily understood by juries, judges, lawmakers, and regulators.

Nilda was included in Benchmark Litigation’s 2018-2022 40 & Under Hot List, selected as a 2015 Rising Star by the New York Law Journal, and has been recognized by The Legal 500 for her work in Product Liability, Mass Tort and Class Action. Justin J. Prochnow assists companies with regulatory, business, and legal needs in the beverage, food, dietary supplement, cosmetic, medical device, and OTC industries. Justin works closely with companies to ensure regulatory compliance with statutes and regulations enforced by the Food and Drug Administration, the Federal Trade Commission and other regulatory agencies. This includes the review of product labels, labeling, advertising, websites and other marketing materials. Justin assists companies with responding to governmental and regulatory actions, including FDA inspections and warning letters, FTC Civil Investigative Demands, and ASRC and NAD cases. He prepares and reviews business documents for industry members, including consulting, manufacturing, supply and distribution agreements. Justin and his team also defend industry companies from both governmental agencies and civil litigators in litigation ranging from breach of contract cases to the growing number of class actions alleging false and misleading advertising.

His litigation practice centers on consumer product defense against false, misleading, or unsubstantiated label and advertising claims, California’s Proposition 65, and consumer class actions. He defends a range of companies, including food and beverage manufacturers, textile businesses, and personal care product brands in lawsuits involving chemicals of concern and related issues. Sean also has experience with high stakes commercial litigation in courts throughout the country and alternative dispute resolution forums, including corporate contractual disputes, trade secrets and employee mobility claims, and business torts.

Sean also counsels manufacturers, distributors, and online and traditional retailers about product safety issues and regulatory compliance, including Consumer Product Safety Commission regulations. He helps companies determine when CPSC should be notified of possible defects and safety issues, navigate recalls, build corrective action plans, and defend enforcement actions. His experience includes home furnishings, household appliances, toys and children’s products, electronics, batteries, packaging, and connected (IoT) devices. Sean also has substantial experience navigating other federal and state laws and regulations that impact consumer product companies, including PFAS prohibitions, greenwashing claims, recycling laws (such as Extended Producer Responsibility), and environmental, social, and governance (ESG) issues. He helps clients ascertain and monitor regulatory compliance obligations, implement required certifications, develop testing programs, and handle enforcement actions or litigation under federal and state laws.

Drawing on his international network and experience as a secondee on the legal hardware safety and compliance team at a global technology company, Sean also helps companies selling products abroad understand and act in accordance with complicated regulatory regimes in countries throughout the world, including in Asia, Europe, Africa, the Americas, the Middle East and many other jurisdictions and regions.
